SWIMMING/ HOT TUB ENTIRE HOUSE WAIVER, LIABILITY, RULES AND REGULATIONS CONTRACT:

I hereby agree that the use of the house, and swimming pool/hot tub is voluntary and at my and my child’s own risk. As a condition of my/our use of the house and swimming pool/ hot tub, I on behalf of myself, my heirs and assigns, and any children, expressly agree to forever discharge, waive and release Owners from any and all claims, demands, injuries, damages, actions, or causes of action of any kind, for all acts of active and passive negligence on account of physical injury, mental anguish, death and/or property damage arising from any accident, loss, damages or injury suffered by my child(ren) or myself or others from, connected with, or caused by, my/our use of the entire house and swimming pool/hot tub, including but not limited to, any injury resulting from mechanical defects or failure of any equipment or devices used in the house swimming pool/hot tub.
Attending this event does not require me to interact with any persons without my explicit consent. I understand that any interactions I initiate with any other participants without their explicit consent may result in my own expulsion from the rental or legal consequences resulting from the unconsented action. I agree to follow all of the instructions posted or given to me by Owner.
I agree to inform the Owner of any unsafe or illegal conditions I observe.
I agree to not allow any nonconsensual touch, bullying or badgering or intimidation of any kind.
I will not provide illegal drugs or prescription medications at this event.
I agree and, by signing this Contract, confirm that I am aware that using the swimming pool/hot tub and entire house is done so at my/our own risk.
Use of the pool/hot tub is open to Renter and Renter’s guests provided that the following rules are acknowledged and followed at all times:
THIS CONTRACT IS LEGALLY BINDING. READ IT CAREFULLY BEFORE SIGNING.
1. Non-Disclosure and Limited Use: Renter shall hold all personal or professional information (Confidential Information) received from Owner in strict confidence and shall not disclose any such Confidential information to any third party whatsoever. Where Renter is an individual, Renter shall not disclose any Confidential Information received from Owner to any other party (including other colleagues, associates or clients of Renter) without the prior written consent of Owner. Where Renter is a company or other type of organization, Renter shall disclose Confidential Information received from Owner only to specific individuals specified by Owner in writing who (i) need to know such Confidential Information to evaluate the opportunity and (ii) have agreed in writing to be bound by this Agreement and not to disclose such Confidential Information to any other party whatsoever without Owner’s express written consent. Renter shall not use any Confidential Information provided by Owner for its own or any other person's benefit or for any other purpose except to evaluate the Opportunity and/or for the purpose of providing professional advice and consultation to Owner.
2. Description of Confidential Information: “Confidential Information” means all information disclosed by Owner to Renter or received by Renter as a result of being in the proximity, professional or personal space of Owner (in writing, orally or in any other form ), including knowledge obtained, including but not limited to, ideas, concepts, trade secrets, speaking engagements, advertisement agreements/ campaigns, online content, and the inner workings of the Owner’s company, including but not limited to business plans, product ideas, marketing concepts, financial information and projection, whether or not having protection under laws and however furnished or received, and whether or not marked or identified as confidential or proprietary information. “Confidential Information” does not include information that is or becomes publicly known through no wrongful act of the party sought to be bound hereby (or any of its employees, if applicable),
3. Remedies: Renter further agrees the unauthorized disclosure or use by it of Confidential Information received from Owner will cause irreparable harm and significant injury to the other that may be difficult to ascertain.
4. Choice of Law: This Non-Disclosure Agreement and any disputes arising from this Agreement shall be governed by the laws of Kings County in the State of New York. Specifically, any disputes arising from this Agreement shall be adjudicated in the State of New York, County of Kings.
